The Second Amendment to the Constitution of the United States says:
"A well regulated Militia being necessary to the security of a free State, the right of the people to keep and bear Arms shall not be infringed. "
Oh the drama this amendment has caused.
Jason was at home caring for his children. All of the sudden, a man started banging on the INNER door of their mudroom. That means the man had already crossed the threshold of the house.
Jason's daughter was on the other side of the door, terrified, and ran to get her daddy. She told him she thought someone was breaking into the house.
Jason grabbed his legally registered handgun, and went to the mudroom door to see what was up. He told the man to get off his property or he'd put "two between his eyes." The man then identified himself as a Rent-A-Center employee (who was not wearing ANY type of uniform) coming for a late payment. Jason apologized, set the gun down immediately. The gun was loaded, but had never been cocked for use.
After the misunderstanding, Mr. Rent-A-Center and Jason had a "cordial conversation" and wrapped things up. In statements given by BOTH parties, these facts are all agreed upon. Yet the Rent-A-Center dude filed a complaint, and now Jason is in prison. He has been there since May of 2009.
ARE YOU KIDDING ME???? This man was WELL within his second amendment rights, and did everything correctly. He owned the gun legally. It was registered. He was protecting his home, property and children. He told the man to leave his property. It's not like the kid walked up to the door shooting. His wife went into premature labor, and their 3rd child was born 8 weeks early, all while Daddy is in jail.
That family may as well have wiped their butts with the Constitution for all the good it did them.
While there is controversy over the Amendment, I can't believe ANYONE would have a problem with what Jason did.
1. The civilian militia interpretation, which holds that the Second Amendment is no longer valid, having been intended to protect a militia system that is no longer in place.
2. The individual rights interpretation, which holds that the individual right to bear arms is a basic right on the same order as the right to free speech.
3. The median interpretation, which holds that the Second Amendment does protect an individual right to bear arms but is restricted by the militia language in some way. (Tom Head About.com)
I personally agree with the second interpretation. The word "militia"has 2 meanings. One is civilians trained as soldiers but not part of the regular army. The second meaning refers to the entire body of physically fit civilians eligable by law for military service. (But not already in the armed forces. No where in the second amendment does it say that civilians may only bear arms during war. This is ridiculous. Thankfully, the NRA is now getting involved and helping to fund Jason's defense. But even if he got out tomorrow, no one can give back the time that has been taken away from him and his young family. He missed the birth of his child, for crying out loud!
The government's controlling grip is getting tighter and tighter. Make no mistake: Obama has a Socialist/Communist agenda, and this is just one tiny example of how it's effecting "Joe Smith" on Main Street USA. And it's only going to get worse.
